A voir dire was held to determine the admissibility of a videotaped statement given by a young person charged with robbery with a firearm and disguise with intent to commit an indictable offence.
The Crown sought to introduce the statement as evidence of the accused's admission to participation in a jewellery store robbery.
The defence opposed admission, alleging that the statement was obtained through police assault and threats in a holding room prior to the videotaped interview.
The court found that the Crown failed to establish beyond a reasonable doubt that the statement was made voluntarily, and therefore excluded the statement from evidence.
