The applicant, a citizen of Turkey, sought judicial review of a decision by the Refugee Appeal Division (RAD) dismissing his appeal from the Refugee Protection Division (RPD).
The RPD had rejected his refugee claim based on numerous credibility concerns.
On appeal to the RAD, the applicant submitted new evidence, including an undated 'Report on Execution of Warrant' which the RAD found admissible as new evidence.
However, the RAD failed to provide any analysis of this new evidence or explain how it weighed against the uncontested negative credibility findings of the RPD.
The Federal Court held that the RAD's failure to consider the admitted new evidence in its assessment of the applicant's credibility rendered the decision unreasonable.
The application for judicial review was allowed, and the matter remitted for redetermination.
