The self-represented father appealed a temporary order and costs award from the Ontario Court of Justice, which required him to pay $2,500 in costs and barred him from bringing further motions until the costs were paid.
The Superior Court of Justice dismissed the appeal, finding it was filed out of time under the Family Law Rules.
The court further noted that even if the appeal had been timely, it would have been dismissed on the merits, as the motion judge properly exercised discretion under Rule 1(8) to enforce compliance with court orders.
The father was ordered to pay $5,000 in costs for the appeal and barred from filing further materials without leave.
