The appellants appealed a decision of the Federal Court of Appeal regarding the jurisdiction of the Canadian Transport Commission to authorize the abandonment of railway tracks.
Pursuant to section 75 of the Supreme Court Act, the Supreme Court of Canada allowed the appeal on consent, set aside the Federal Court of Appeal's decision, and restored the decision of the Railway Transport Committee.
