The applicant First Nation sought judicial review of a decision by the Minister of Environment and Climate Change not to designate an oil sands mine extension project for a federal environmental assessment.
The applicant argued the decision triggered the duty to consult and was unreasonable.
The Federal Court dismissed the application, finding that the duty to consult was not triggered because the decision did not have the potential to adversely affect the applicant's Treaty rights, as the project would be subject to a provincial environmental assessment.
The Court also held the Minister's decision was reasonable, as the Minister properly considered the applicant's concerns and the available information.
