Tribunal vests deceased's mining claims in Estate Trustee and grants extension for assessment work.
The applicant, as Estate Trustee for the deceased claim holder, applied to the Ontario Land Tribunal for an order vesting the deceased's unpatented mining claims in her name.
The applicant also sought an extension of time to perform and file prescribed assessment work on the claims.
The Tribunal granted the application, vesting the mining claims in the applicant as Estate Trustee, and ordered an exclusion of time, setting a new anniversary date one year from the issuance of the order for the assessment work to be performed.
Tribunal orders pending proceedings noted on active mining claims pending determination of estate's vesting application.
The applicant, as Estate Trustee for the deceased, applied for a vesting order and relief from forfeiture regarding several unpatented mining claims held by the deceased.
As the Tribunal lacked jurisdiction to grant relief from forfeiture, it exercised its discretion under s. 64(2.1) of the Mining Act to issue an Order of pending proceedings for the active mining claims.
The Provincial Mining Recorder was directed to note the pending proceedings on the abstracts of the active claims.
