The applicant, the aunt and former adoptive parent of three children, filed a complaint with the Child and Family Services Review Board alleging the respondent society failed to hear her concerns regarding access and staff bias.
The respondent argued the Board lacked jurisdiction because the applicant was no longer a 'parent' under the Child, Youth and Family Services Act, 2017, as the children had been placed in extended society care by a court order.
The Board agreed, finding that the applicant lost her parental rights and the court had already decided the issue of access.
The application was dismissed for lack of jurisdiction.
