The appellant grain dealer appealed an order of the Canadian Grain Commission requiring it to pay the respondent producer for loss or damage resulting from the appellant's failure to provide timely grain receipts and its making of an improper deduction.
The Federal Court dismissed the appeal, finding no palpable and overriding error in the Commission's conclusions that the appellant violated the Canada Grain Act by failing to provide the receipts contemporaneously with delivery and by deducting a handling levy and price discount not agreed to by the producer.
