The applicant filed a human rights application alleging discrimination in employment based on age and disability, and reprisal, following his termination.
The respondent requested dismissal under s. 45.1 of the Human Rights Code, arguing the matters were already dealt with by an Employment Standards Officer (ESO).
The Tribunal found that the ESO decision appropriately dealt with the termination and reprisal issues, dismissing those portions of the application.
However, the Tribunal held that the ESO did not address whether the applicant was appropriately accommodated prior to termination, allowing that portion of the application to proceed.
