The Plaintiff sought an interlocutory injunction to stop the Defendants from linking their products to the Plaintiff's product pages on Amazon.ca, alleging trademark and copyright infringement.
The Federal Court dismissed the motion, finding that the requested injunction was mandatory in nature and the Plaintiff failed to establish a strong prima facie case.
Furthermore, the Plaintiff did not demonstrate with convincing evidence that it would suffer irreparable harm if the injunction was not granted.
