The appellant appealed the City of Stoney Creek's decision to deny access to minutes of meetings held by the City Review Committee regarding a proposed landfill site.
The City claimed exemptions under sections 7(1) (advice and recommendations), 11(e) (economic and other interests), and 12 (solicitor-client privilege) of the Municipal Freedom of Information and Protection of Privacy Act.
The Inquiry Officer found that the City could not raise discretionary exemptions late in the process without justification.
The Officer upheld the application of section 7(1) and section 12 to small portions of the records but ordered the disclosure of the majority of the records, finding that section 11(e) did not apply as the relevant negotiations had concluded.
The public interest override in section 16 was found not to apply to the exempt portions.
