1The applicant filed an Application alleging discrimination contrary to the Human Rights Code, 1990, c. H. 19, as amended. By Interim Decision 2016 HRTO 1111, the Tribunal held that it would not defer the Application pending another proceeding involving the applicant. By Case Assessment Direction dated September 8, 2017, the Tribunal directed a summary hearing into the Application. The summary hearing by teleconference is scheduled for January 9, 2018.
2The applicant has requested that the Tribunal defer the summary hearing until his appeal in the ongoing proceeding in which he is involved is complete. He also objected to the summary hearing being conducted by teleconference.
3The respondent opposed the applicant’s requests.
4The Tribunal has already determined that it will not defer this Application due to the ongoing proceeding involving the applicant. In my view, the fact that the applicant is appealing the initial decision in the proceeding is not a reason to change its determination on the issue of deferral.
5While the applicant opposes proceeding with the summary hearing by teleconference, he has provided no valid reason for his position.

6For the reasons set out above, the applicant’s deferral request is denied and the summary hearing will proceed January 9, 2018 by teleconference.
