1The applicant has filed an Application alleging discrimination on the basis of goods, services and facilities because of sexual orientation and age contrary to the Human Rights Code, 1990, c. H. 19, as amended (“the Code”).
2The Tribunal has not yet sent the Application to the respondent for Response.
3The Tribunal sent a Notice of Intent to Defer letter to the parties, dated July 6, 2016, asking for them to file submissions as to whether or not the Application should be deferred pending resolution of another legal proceeding.
4Both parties have filed submissions, and both parties submit that the Application should not be deferred.
5Based upon the submissions, I have determined that the Application should not be deferred.
6Accordingly, within 35 days from the date of this Interim Decision, the respondent is directed to file a Response with the Tribunal.
7I am not seized of this matter.
