1The Application alleged discrimination because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), in the special diet allowance provided under Ontario’s social assistance system. In a Case Assessment Direction (“CAD”) dated April 3, 2014, the applicant was directed to provide material and submissions by April 30, 2014 in support of his claims with respect to digestive problems; insomnia; panic attacks; and post-traumatic stress disorder. The Case Assessment Direction advised the applicant that a failure to provide this information would result in his claims with respect to these conditions being dismissed as abandoned.
2The applicant has not filed any materials nor communicated with the Tribunal in any manner with respect to his claims with respect to the above conditions.
ORDER
3The claims set out in the applicant’s special diet claims with respect to digestive problems; insomnia; panic attacks; and post-traumatic stress disorder are dismissed as abandoned.
4In its April 3, 2014 CAD, the Tribunal directed the parties to advise the Tribunal by April 30, 2014 of the status of the complainant’s claim with respect to hepatic disorder – hepatitis C in light of the Tribunal’s decision in Martel v. Ontario (Community and Social Services), 2012 HRTO 735 upheld 2012 ONSC 6680. Neither party has advised the Tribunal of the status of the applicant’s claim regarding this condition. The applicant and the respondent are both directed to provide the Tribunal with an update regarding the applicant’s claim regarding hepatic disorder – hepatitis C by May 23, 2014 in order to ensure the proper resolution of this claim.
