1In a previous Interim Decision, 2012 HRTO 856, the Tribunal deferred this Application pending the conclusion of three grievances filed with the applicant’s union, the Canadian Union of Public Employees (“CUPE”). In Interim Decision, 2013 HRTO 658, the Tribunal declined the applicant’s Request to proceed with the Application because the materials filed in support of the Request did not establish that all three grievances had been withdrawn.
2On May 8, 2013, the applicant filed a Request for Order During Proceeding, again seeking to reactivate her Application and included letters from CUPE indicating all three grievances have been withdrawn. The respondent filed a letter on May 13, 2013, indicating that it took no position regarding the request.
3In the circumstances, the request to proceed is appropriate and is granted. The Application shall be returned to the Registrar for processing.
