1In a previous Interim Decision, 2012 HRTO 856, the Tribunal deferred this Application pending the conclusion of three grievances filed with the applicant’s union, the Canadian Union of Public Employees (“CUPE”). Those proceedings have now concluded because the applicant consented to the withdrawal of the grievances. On March 20, 2013, the applicant filed a Request to proceed under Rule 14.3. Neither the respondent nor the CUPE responded to the Request.

2However, the materials filed in support of the Request indicate that only two of the three grievances have actually been withdrawn. In these circumstances, the Request to proceed is denied.
