1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on September 29, 2010.
2In Interim Decision 2011 HRTO 1228 issued June 28, 2011, the Tribunal at the request of the parties agreed to hold the Application in abeyance until October 1, 2012. The Tribunal advised the parties that it will take no further steps until contacted by one of the parties advising the Tribunal that the Application should proceed and that if the Tribunal does not receive a request to proceed with the Application within six months of October 1, 2012, the Application may be dismissed as abandoned.
3Neither party to the Application has contacted the Tribunal to advise that the Application should proceed and the time for doing so has now elapsed.
4In the circumstances, the Application is deemed abandoned and the Application is dismissed.
