1This Application alleges discrimination with respect to services because of race and colour contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The applicant alleges that he was discriminated against by the two named officers when he was waiting for a friend to join him at a soccer game held at BMO Field, which he also named as a respondent to his Application.
2Counsel for BMO Field filed a Request for Summary Hearing (Form 26) saying that it is not a legal entity and, in any event, the Application contains no allegations of discrimination or harassment by it or any employee of it. The submissions attached to the Request point out that all the allegations of discrimination and harassment are against the named police officers and took place outside the grounds of BMO Field.
3The applicant filed a Response to a Request for an Order (Form 11) in which he stated that he had no objection to the removal of BMO Field as a respondent. He stated that he had intended to name the employer of the security guards he dealt with, which he mistakenly thought was this organization.
4Counsel on behalf of the remaining respondents advised in writing that they had no objection to Application being dismissed against BMO Field.
5In light of the apparent mistake made by the applicant and the general agreement by the parties, BMO Field is removed as a respondent to this Application and the title of proceedings amended accordingly.
