1This Application alleges discrimination with respect to services because of race and colour contrary to the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended. The Application was originally filed as against the Toronto Police Services, two named police officers and BMO Field.
2By way of Interim Decision 2013 HRTO 260, based on the general agreement of the parties, the Tribunal ordered the removal of BMO Field as a respondent to the Application.
3On July 16, 2013, the applicant filed a Request for an Order During Proceedings seeking to name the Board of Governors of Exhibition Place as a respondent party to the Application.
4On July 30, 2013, the Board of Governors of Exhibition Place filed a response to the RFOP consenting to being added as a respondent party.
5It appears appropriate to add the Board of Governors of Exhibition Place as a respondent. The Board of Governors of Exhibition Place has confirmed that it is responsible for the security services at BMO Field and is the employer of security guards allegedly involved in the incident that forms the basis of the Application.
ORDERS
6The Board of Governors of Exhibition Place is added as a respondent and the style of cause is amended to reflect the same.
7The Board of Governors of Exhibition Place is directed to file its Response (Form 2) within 35 days of the date of this Interim Decision. The applicant is directed to file a Reply within 14 days of the receipt of the Response.
8A mediation scheduled for this Application was cancelled by the Tribunal as a result of the various preliminary matters. The Tribunal will reschedule the mediation for a date following the filing of the above-noted pleadings.
9I am not seized.
