1By way of Interim Decision 2012 HRTO 1209, the Tribunal deferred this Application pending the conclusion of a Small Claims Court action related to the parties in this matter.
2On September 20, 2012, the applicant filed a request to reactivate his Application on the basis that the Small Claims Court proceeding was concluded. The applicant provided a copy of a Superior Court of Justice Order dated September 20, 2012 setting out judgement for each of the parties.
3On October 10, 2012, the respondent filed a response to the request to reactivate. The respondent confirms that the Small Claims Court action is concluded and that the respondent does not object to reactivation.
4Given that the Small Claims Court process has completed and the respondent agrees with reactivation, I find that it is appropriate to reactivate this Application.
5Accordingly, the Application will continue in the Tribunal’s process and the Tribunal will schedule mediation for this matter.
6I am not seized.
