1By way of Interim Decision 2012 HRTO 971, the Tribunal sought the parties’ submissions as to the issue of deferral of this Application given the existence of a concurrent Small Claims Court action involving the parties. The parties have confirmed that the Small Claims Court matter is scheduled for trial on July 4, 2012. The parties agree that the Application should defer pending the conclusion of the Small Claims Court matter in order to avoid the possibility of inconsistent decisions of fact or law.
2In these circumstances, the Tribunal orders that this Application is deferred pending the conclusion of the Small Claims Court action.
3Where a party wishes to proceed with an application which has been deferred, the party must make a Request for an Order During Proceedings in accordance with Rule 19 within 60 days after the conclusion of the other proceeding (Rules 14.3 and 14.4).
