1By Interim Decision dated September 14, 2012, the Tribunal denied the applicant’s request for an adjournment. On the same date, applicant’s counsel sought reconsideration of the Tribunal’s Interim Decision.
2The request is denied. The Tribunal’s reconsideration process, as set out at Rule 26 of the Tribunal’s Rules of Procedure is available for final decisions of the Tribunal (see also the Tribunal’s Practice Direction on Reconsideration). There is nothing in the current circumstances to suggest that the adjournment decision was a final decision within the meaning of the Tribunal’s Rule or well-established case law, see especially Sigrist and Carson v. London District Catholic School Board et al., 2008 HRTO 34.
3The Tribunal refused the applicant’s adjournment request because counsel with carriage of the matter has not changed. The fact that counsel is not ready for the hearing scheduled for September 27 and 28, 2012 does not constitute exceptional circumstances required to grant the adjournment.
4The Tribunal’s decision of September 14, 2012 remains unchanged. The parties should be ready to proceed on September 27, 2012.
