1This is an Application filed November 26, 2010, pursuant to section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended. On March 7, 2011, I ordered consideration of the Application deferred pending the conclusion of a related criminal proceeding where the applicant and the personal respondent Joe (Anh Chau) To were, respectively, the alleged victim and accused (see 2011 HRTO 485).
2The purpose of this Interim Decision is to deal with the applicant’s Request for Order During Proceedings filed June 28, 2011, seeking reactivation of the Application because the related criminal proceeding has concluded with the withdrawal of the charge(s) and the personal respondent Joe (Anh Chau) To entering into a recognizance pursuant to s. 810 of the Criminal Code of Canada, R.S.C., 1985, c. C-46.
3The respondents have not filed submissions in response to the Request to reactivate.
4Given that the issues raised in the Application are no longer being considered by the Courts, it is appropriate to reactive the Application.
ORDER
5The Application is reactivated.
6As the parties have indicated a willingness to participate in mediation, the file will be placed in the queue for scheduling a mediation in this matter
7I am not seized.
