1In a Case Assessment Direction dated March 1, 2011, the Tribunal directed that it would hold a teleconference hearing to address the applicant’s request to amend this Application and the respondents’ request that the Application be dismissed pursuant to s. 45.1 of the Human Rights Code (the “Code”), R.S.O. 1990, c. H.19, as amended. The respondents’ request alleges that a complaint and investigation pursuant to the Police Services Act, R.S.O. 1990, c. P.15, appropriately dealt with the issues raised in this Application.
2The issue of the application of s. 45.1 in the context of the Police Services Act is a significant one, and it arises in both this case and in Shallow v. Toronto Police Services Board, 2011 HRTO 1407. Therefore, a copy of this Interim Decision will be sent to the Ontario Human Rights Commission and the Office of the Independent Police Review Director. Should either of them, or any other organization, seek to intervene in either or both of these cases, a Request to Intervene or Notice of Commission Intervention shall be filed no later than one month from the date of this Interim Decision.
