1The applicant requests reconsideration of the Decision dated April 19, 2011 dismissing this Application on the basis that it is outside the Tribunal’s jurisdiction, 2011 HRTO 775. The applicant relies upon Rule 26.5 (a), asking for reconsideration on the basis that “[t]here are new facts or evidence that could potentially be determinative of the case and that could not reasonably have been obtained earlier”. The request for reconsideration was filed with the Tribunal on June 29, 2011.
2The substance of his request expresses the applicant’s strong disagreement with the Tribunal’s conclusion that the Application does not fall under the social area of services. However, the applicant provides no new evidence or facts that could not reasonably have been obtained earlier. Reconsideration is not an opportunity to reargue one’s case and is granted only in exceptional circumstances: Sigrist and Carson v. London Catholic District School Board, 2008 HRTO 34. The applicant has made no arguments that justify reconsideration.
3Accordingly, I need not deal with the issue of the timeliness of the Request.
4The Request for Reconsideration is dismissed.
