1This is an Application filed December 31, 2010, under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code").
2On April 29, 2011, the applicant filed a Request for an Order During Proceedings ("Request") to defer her Application due to health reasons. The applicant attached a note from her physician supporting her Request for deferral. She indicates in her Request that, after consultation with her doctor, it was felt best that this matter be deferred until such time as her doctor determines.
3On May 4, 2011, the respondent filed a Response to the applicant's Request for deferral, consenting to the Request.
4In the circumstances, the Tribunal determines that it is appropriate to hold this matter in abeyance. However, having regard to the Tribunal's mandate to proceed in a fair, just and expeditious manner, it would not be appropriate to hold this matter in abeyance indefinitely. Unfortunately, the applicant did not provide any information with respect to when she or her doctor anticipates her health issues will abate sufficiently for her to proceed with this Application. This makes it difficult to choose a fixed time period. The Tribunal will therefore hold this matter in abeyance for a period of six months, or until the applicant advises the Tribunal and the respondent that she is ready to proceed with the Application, whichever is sooner.
5If the applicant does not communicate with the Tribunal on or before December 14 2011, the Application may be dismissed as abandoned.
6I am not seized of this matter.
