1On March 15, 2010, the Tribunal issued Interim Decision 2010 HRTO 554. It determined that consideration of the Application will be deferred until a civil action commenced by the Applicant against the respondent has been resolved. The Interim Decision found that it was appropriate for the Tribunal to defer consideration of the Application because the civil action involves issues that are relevant to the issues raised in the Application and because the court proceeding was relatively advanced.
2The applicant has subsequently filed two Requests for Order During Proceedings. The more recent of these is a Request that the Application be reactivated. As noted by the respondents, since there have been no further developments in the civil action, the Request is in effect a request to reconsider the Interim Decision. The applicant has restated her position that there is no overlap between the issues raised in the civil action and those raised in the Application.
3In its Response to the Request for Order During Proceedings, the respondent restates its position that there is substantial overlap between the issues raised in the Application and the issues raised in the civil action. The respondent further advises that the next scheduled date in the civil action matter is May 13, 2010.
4No new information has been presented that might cause the Tribunal to reconsider the Interim Decision or to reactivate consideration of the Application at this time.
5The earlier Request for Order During Proceedings asks the Tribunal to order the respondents to disclose information and documents. Since the Tribunal has deferred consideration of the Application, this request is premature.
