BACKGROUND
1The applicant filed two Applications regarding related matters against the same respondent.
2On September 30, 2010, the Tribunal issued an Interim Decision, 2010 HRTO 2009 regarding these Applications. The Interim Decision noted that the Tribunal had issued a Notice of Intent to Dismiss and invited the applicant to file submissions in that regard; however, the applicant did not file any such submissions.
3The Interim Decision directed the applicant to file written submissions with respect to issues of delay and previous human rights complaints (section 53(8)). The Interim Decision expressly indicated that, if the applicant did not file written submissions within fourteen days of the date of the Interim Decision, the Tribunal may consider the failure to respond as an abandonment of the Applications and dismiss the Applications for that reason.
4The applicant did not respond to the Tribunal’s Notice of Intent to Dismiss and did not file written submissions in accordance with the deadline set out in the Interim Decision.
5In the circumstances, the applicant is deemed to have abandoned the Applications. Accordingly, both Applications are dismissed.
6I am not seized.
