1This Application was filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended on February 24, 2009. On March 18, 2009 the applicant’s representative from the Canadian Union of Public Employees advised that the Application was sent in error and she would like to withdraw it. In a subsequent letter dated March 23, 2009, the applicant’s representative advised that she would like to revise and re-file the Application. On March 30, 2009, the applicant’s representative filed a formal Request for Order During Proceedings requesting the opportunity to amend the Application, advising that a draft, rather than a final copy was inadvertently sent to the Tribunal. The Request does not include a copy of the new Application.
2The respondent takes the position that the applicant should be required to withdraw, not amend the Application and seeks direction on whether it needs to file a response to the initial Application. Counsel also notes that there are outstanding grievances raising the same issues as those addressed in the Application and that the respondent’s position will be that the Application should be deferred pending the conclusion of the grievance process.
3In the circumstances, I am of the view that it would be fair, just and expeditious to proceed as follows:
By May 13, 2009, the applicant shall deliver to the respondent and file with the Tribunal a revised Application. The Application should include information about the status of the grievance and the applicant’s position on deferral.
The Tribunal will give further directions following receipt of the revised Application.
The respondent need not take any steps until the Tribunal gives further directions.
