1This is an Application filed June 3, 2009 under section 53(5) of Part VI of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2By Interim Decision 2009 HRTO 1530, the Commission was ordered to produce the Minutes of Settlement filed by the parties. These documents were produced to the Tribunal by letter, dated September 28, 2009. The Minutes show that they were signed by the applicant at the mediation on Wednesday, March 19, 2008 but not signed by all respondents until Tuesday, March 25, 2008.
3The applicant says that after the mediation, he called the Commission mediator (Rod Loi) to say that he had changed his mind. The respondents say that this call was made after they had sent in the settlement documents to the Commission.
4The Commission's file should have a record of any phone call made to the mediator by the applicant following the mediation. The Commission is hereby directed to immediately produce to the Tribunal and to the parties any and all records of communications, including the content of those communications, between the applicant and the Commission during the period from March 19, 2008 to April 19, 2008.
5As the Case Resolution Conference (hearing) in this matter is proceeding on Wednesday, October 14, 2009 commencing at 9:30 a.m., the Commission is directed to produce this material by the end of the day today.
