1This Application was filed June 2, 2009 under section 53(5) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). This Interim Decision deals with a Request for Order During Proceedings seeking to add parties as respondents to this proceeding.
Background
2In her original complaint to the Ontario Human Rights Commission dated February 6, 2007, the applicant alleges that she was discriminated against because of sex with respect to her work environment. The respondents deny the alleged discrimination.
Addition of Parties
3The applicant seeks to add Paul Murray and John Brock as respondents. The only allegation against them relates to a request by Mr. Brock to meet with him and Paul Murray on April 16, 2007 to discuss the terms of her termination. The applicant was subsequently given a letter of termination on April 17, 2007. These events post-date the original complaint and do not form part of the subject matter of the Application before me. Therefore, there is no basis to add these persons as respondents.
4The applicant has indicated that she wishes to amend her Application to add an allegation of reprisal, as her employment was terminated on April 17, 2007, after she filed the original complaint. The applicant is directed to file a Request for an Order during Proceedings with respect to the requested amendment within 14 days of receipt of the Interim Decision, if she intends to proceed with the requested amendment.
5The request to add parties is denied.
