Paul Ravenhill v. Humber College Institute of Technology and Advanced Learning, 2009 HRTO 1285

1The applicant filed an Application under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”), on March 25, 2009.

2On August 5, 2009, the Tribunal issued an interim decision (2009 HRTO 1208) in which it noted that the applicant had stated an intention to withdraw his Application but had not filed or served a Request to Withdraw (Form 9) despite being directed to do so by the Tribunal. The Tribunal stated that it would dismiss the Application as having been abandoned if the applicant did not communicate with the Tribunal by Wednesday, August 12, 2009.

3The Tribunal has not heard from the applicant as of this date. Given these circumstances the Tribunal dismisses the Application as having been abandoned pursuant to Rule 5.4 of the Tribunal’s Rules of Procedure.
