The applicant sought an order to adopt an adult child (D), who is the biological son of the applicant's spouse.
The applicant also sought an order dispensing with notice and service to the biological father.
The court dismissed the motion to dispense with notice and service, holding that: (1) parental consent is not required for adult adoptions under subsection 146(3) of the Child and Family Services Act; (2) however, notice and service to the biological father is required; (3) the biological father must be added as a party to enable the court to decide all issues; and (4) the test for dispensing with notice and service under the Family Law Rules was not met.
