Members of a First Nation commenced a civil action alleging malicious prosecution, false arrest, intentional infliction of mental suffering, and defamation arising from interactions with band officials and trespass notices issued restricting access to band offices.
They also alleged that the band was responsible for criminal charges laid against one of the plaintiffs and that the plaintiffs were targeted due to activism and racial bias.
After a lengthy trial, the court found no evidence supporting the allegations and concluded the plaintiffs had engaged in repeated abusive and disruptive conduct toward band employees.
The court determined that trespass notices and other measures taken by the band were reasonable responses to workplace safety concerns and that the police independently decided to lay criminal charges.
Many claims were also statute-barred under applicable limitation periods.
The action was dismissed in its entirety.
