The Federal Court found the officer reasonably concluded that the separation from the grandchildren did not warrant exceptional relief, as the children were not facing relocation.
The Court also found reasonable the officer's conclusion that there was insufficient evidence the applicant would be personally negatively impacted by adverse country conditions in India.
The application for judicial review was dismissed.
