MPAC brought a motion to dismiss the appeals related to 300 Hagey Boulevard due to the respondent's failure to comply with a prior Board order to produce information, and to bar the respondent's representative from acting as a witness for the appeals related to 455 Phillip Street.

The Assessment Review Board granted both motions.

The Board found that the respondent failed to comply with the production order without adequate excuse, warranting dismissal of those appeals.

The Board also found that the representative had acted as an advocate on the file and was therefore prohibited by the Board's Rules from also acting as a witness.
