The appellant appealed a Committee of Adjustment decision denying variances for a proposed warehouse development in an employment area.

Following an interim decision that approved side yard and driveway variances but required the removal of a front yard loading space, the appellant sought an additional variance to reduce the access width to a rear loading space from 6.0m to 3.65m.

The Toronto Local Appeal Body found the amendment minor, requiring no further notice.

Relying on uncontested expert planning evidence and a swept path analysis accepted by the City, the Tribunal found the variance met the four tests under the Planning Act and authorized the variance.

The appellant appealed the Committee of Adjustment's refusal of minor variances required to construct a new building with a bingo hall, restaurant, and electronic gaming uses on a property designated General Employment Areas.

The tribunal accepted the uncontradicted expert planning evidence that the proposed uses, including the electronic bingo component, maintain the general intent and purpose of the Official Plan and Zoning By-law.

The tribunal authorized the variances subject to conditions, including limiting the games arcade permission strictly to electronic bingo.

The appellant sought minor variances to demolish a single detached house and build a new two-storey house with an integral garage.

The requested variances included an increase in the permitted floor space index and reduced side yard setbacks.

The Toronto Local Appeal Body found that the proposed design, particularly the two-storey over integral garage, failed to respect and reinforce the existing physical character of the neighbourhood and did not comply with the Long Branch Neighbourhood Character Guidelines.

The appeal was dismissed and the variances were not authorized.
