Following a settlement between the parties, the Ontario Land Tribunal approved the revised Draft Plan of Subdivision, subject to conditions.
The Tribunal relied on uncontradicted expert planning evidence to find that the proposal was consistent with the Provincial Policy Statement and conformed to the applicable official plans.
Final approval of the plan of subdivision was referred back to the City.
