The appellants appealed the Committee of Adjustment's denial of a severance and minor variance applications to create a new residential lot.
The proposed variances sought reduced lot areas for both the severed and retained parcels, and a reduced rear yard setback for the retained parcel.
The Tribunal found that the proposed variances failed all four tests under s. 45(1) of the Planning Act, as the resulting lots would be incompatible with the neighbourhood fabric and inconsistent with the City's Official Plan and Zoning By-law.
The appeal was dismissed.
