The appellant appealed the City of Welland Committee of Adjustment's denial of a minor variance application to permit a reduction in required parking spaces from eight to zero and to allow 100 percent residential use on the ground floor of an existing vacant commercial building.
The appellant proposed to retrofit the building to create 14 residential units, utilizing an informal parking arrangement on adjacent City-owned land.
The Tribunal allowed the appeal and authorized the variances, finding that the proposal was consistent with provincial policies, conformed to the Growth Plan, and met the four tests for a minor variance under the Planning Act by providing transit-supportive intensification and adaptive reuse of an underutilized building.
