The Town of Milton brought a motion on consent to bring Official Plan Amendment No. 86 and Zoning By-law Amendment No. 036-2025 into full force and effect, save and except for specific properties that remain under appeal.

The Tribunal accepted uncontroverted planning evidence that partial approval would provide clarity and promote orderly planning without prejudicing the appellants.

The Tribunal ordered the instruments into full force and effect on a Town-wide basis, with the site-specific appeals adjourned sine die.

The Tribunal heard a written settlement motion regarding appeals of Official Plan Amendment No. 54 (Trafalgar Secondary Plan) in the Town of Milton.

Based on the uncontradicted land use planning evidence of a Registered Professional Planner, the Tribunal found that the remaining policies, which largely address the Natural Heritage System, are consistent with provincial policies and represent good planning.

The Tribunal allowed the appeals in part and approved the modified policies of OPA 54.

The appellants appealed the Region of Halton's approval of Official Plan Amendment No. 54 (the Trafalgar Secondary Plan) to the Town of Milton Official Plan.

Following negotiations, the parties reached a partial settlement regarding approximately 61 policies, leaving 16 policies unresolved.

Based on the uncontroverted expert planning evidence, the Tribunal found the resolved policies were consistent with provincial policy and represented good planning.

The Tribunal allowed the appeals in part, modifying and approving the resolved policies while withholding approval on the unresolved policies.
