The appellants appealed the City of Kawartha Lakes' 2014 Development Charge By-laws under the Development Charges Act.

The Tribunal considered several issues in a phased hearing, including the allocation of capital costs for library expansions, fire administration facilities, storm sewer capacity studies, water pollution control plant upgrades, bridge replacements, and road reconstruction programs.

The Tribunal largely preferred the evidence of the appellants, finding that several projects were either ineligible for development charges, primarily benefited existing development, or lacked sufficient transparency and detail in the background study.

The Tribunal ordered the removal or recalculation of various capital costs from the development charge calculations and withheld its final order pending a further reconciliation of the charges.
