The Tribunal found that under the updated Canadian Council of Motor Transport Administrators' National Safety Code Standards, commercial drivers with an ICD are disqualified from commercial driving.
Relying on the medical advisory committee's report, the Tribunal concluded that the appellant's medical condition was likely to significantly interfere with his ability to drive a commercial vehicle safely.
The licence downgrade was confirmed.
