The parties reached a settlement and jointly requested that the Tribunal repeal the by-law in its entirety.
Relying on uncontradicted expert planning evidence, the Tribunal found the settlement consistent with provincial policies, in conformity with the official plan, and representative of good planning.
The appeal was allowed and the by-law was repealed.
