The appellant, a registered real estate salesperson, appealed a proposal by the Registrar to revoke his registration after he was caught on video stealing small items and money from a consumer's home during a showing.
The appellant admitted to the theft and sought psychotherapy to address underlying issues.
The Licence Appeal Tribunal found that while the theft was a fundamental breach of trust, the appellant's remorse, motivation to change, and lack of prior complaints indicated he could carry on business with integrity.
The Tribunal ordered the Registrar not to carry out the proposal to revoke the registration, but imposed strict conditions, including a requirement that the appellant not attend any property unaccompanied for three years.
