Tribunal approves settlement amending Region of Niagara's development charges by-law.
The appellants appealed the Region of Niagara's Development Charges By-law No. 2022-71 and By-law No. 2022-94 under section 14 of the Development Charges Act, 1997.
The parties reached a full settlement.
Based on the settlement and the supporting affidavit of a land use economist, the Ontario Land Tribunal dismissed the appeal regarding By-law 2022-71 and allowed the appeals regarding By-law 2022-94 in part, amending Schedule 'C' of the by-law to reflect the revised rates.
