Appeals allowed in part to implement settlement permitting lot severance and six-unit residential building.
The appellant appealed the failure of the municipal Committee of Adjustment to make a decision on a consent application and a zoning by-law amendment to facilitate the severance of a lot and construction of a two-storey, six-unit residential building.
Prior to the hearing, the parties reached a settlement.
Based on the uncontroverted expert land use planning evidence of the municipal planner, the Tribunal found the proposed development was consistent with the Provincial Policy Statement, conformed to the applicable official plans, and satisfied the criteria under section 51(24) of the Planning Act.
The appeals were allowed in part to implement the settlement.
