Locomotive event recorder data provided to TSB not exempt from disclosure under ATIA.
The applicant railway company brought an application under section 44 of the Access to Information Act seeking to prevent the disclosure of data from a locomotive event recorder that it had provided to the TSB for an accident investigation.
The applicant argued the data was confidential technical information under s 20(1)(b).
The Federal Court found that the raw data collected by the recorder was not intrinsically confidential and did not benefit from the statutory privilege for witness statements under s 30 of the CTAISB Act.
However, the Court ordered that certain comments added to the record by an employee were exempt from disclosure.
The application was otherwise dismissed.
