Sentencing decision following guilty pleas to making child pornography, distributing child pornography, and impaired operation of a motor vehicle.
The child pornography offences were facilitated by sexual interference involving the offender's young children, and the court treated the abuse of trust and enduring harm to the children as highly aggravating.
Applying the proportionality principle and the guidance in sexual offences against children cases, the court held that denunciation and deterrence had to predominate notwithstanding the offender's lack of prior record, mental health issues, addiction, guilty plea, and remorse.
A penitentiary sentence of five years was imposed on the child pornography counts, concurrent with 15 days for impaired driving, together with ancillary orders.
