The applicant brought a family law motion seeking clarification of an earlier costs order arising from a trial judgment, in order to identify the portion of the costs award attributable to support issues.
The court approved irregular service by Facebook message and email where the respondent appeared to be evading service and the evidence supported that the materials had come to her attention.
Relying on the trial record and prior reasons, the court found that the bulk of the case concerned support and apportioned 90 percent of the $28,000 costs award, or $25,200, to support issues.
The court also ordered that the respondent's costs debt be repaid at $400 per month by set-off against ongoing support, with no costs of the motion.
